Baby AI — AI Photo Generator

These Terms of Use (“Terms”) are an agreement between you and Sunmare Digital Teknoloji Yazılım Sanayi ve Ticaret Limited Şirketi (“Sunmare Digital”, “we”) for the use of the Baby AI — AI Photo Generator app. By downloading or using the App you accept these Terms. If you do not agree, please do not use the App. Our Privacy Policy explains how we handle your data.

1. Licence to use the App

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for your personal, non-commercial use, in line with these Terms and the rules of the App Store or Google Play. You may not copy, sell, rent, sublicense, reverse engineer or modify the App, or try to bypass its limits, payment or security features, except where the law allows it.

If you downloaded the App from the Apple App Store, Apple’s Licensed Application End User License Agreement also applies; Apple is not responsible for the App or its support.

2. Who can use the App

You must be at least 18 years old (or the age of majority where you live). The App is meant for adults, mainly parents, and is not directed at children.

3. Your photos and your responsibility

• You may only upload photos that you have the right to use. For photos of a child you must be the child’s parent or legal guardian or have their permission. For photos of any other person (for example a partner used as “Mother” or “Father”) you must have that person’s consent.
• You keep all rights you have in your photos. You give us a limited licence to store, process and transmit them (including to our AI provider) only as needed to create your results and run the App.
• You are responsible for the photos you upload and for how you use and share your results.

4. Prohibited uses

You agree not to use the App to:

• upload photos of other people’s children, or of any person, without the necessary consent;
• create or share sexual, sexually suggestive, violent, hateful or humiliating content, and in particular never any sexual content involving minors;
• impersonate, deceive, harass, bully or defame anyone, or create fake evidence or misleading “real” photos of real people;
• infringe anyone’s privacy, image, copyright, trademark or other rights;
• break any law or the rules of the App Store or Google Play;
• attack, overload, scrape or misuse the App or our servers, or resell its output as a service.

We may block requests, remove content and report illegal content (especially content that exploits children) to the authorities.

5. AI-generated content

• Results are artistic images and videos created by artificial intelligence, made for fun. They are not real photographs and may not look exactly like the people in your photos.
• Future baby results are entertainment only. They are not a prediction of what a real child will look like and are not based on genetics or medical science.
• Nothing in the App is medical, health, developmental or parenting advice. Ask a doctor or other professional for such questions.
• AI can make mistakes or produce unexpected results. Generation may sometimes fail; when a paid item fails, its coins are returned automatically.
• Subject to these Terms and the AI providers’ terms, you may use your results for personal purposes. Results for free users may carry a watermark. Our templates, designs, catalog images and the App itself remain our property or that of our licensors.

6. Subscriptions, coins and payments

• Coins. Creating images and videos uses coins. The cost of each template is shown in the App before you start.
• Subscriptions. We offer weekly and yearly subscriptions. Subscriptions remove ads and grant coins: weekly subscribers receive coins each week, and yearly subscribers receive a weekly coin refill. The exact amounts and prices are shown in the App before you buy.
• Coin packs. You can also buy one-time coin packs.
• Billing and renewal. Payment is charged to your App Store or Google Play account. Subscriptions renew automatically at the end of each period at the then-current price unless you cancel at least 24 hours before the period ends. If a free trial is offered, it converts to a paid subscription unless cancelled before it ends.
• Cancelling.Manage or cancel your subscription in your App Store account settings (iOS) or in Google Play → Payments & subscriptions (Android). Deleting the App does not cancel a subscription.
• Restore purchases.Use “Restore” in the App to restore subscriptions on a new device or after reinstalling.
• Refunds. Purchases are processed by Apple or Google, and refunds are handled by them under their policies. You can request a refund from Apple (reportaproblem.apple.com) or Google Play. Nothing in these Terms limits refund rights you have under mandatory consumer law.
• Coins have no cash value. Coins are a limited licence to use App features. They cannot be exchanged for money, transferred or sold, and are not refundable except where required by law or store policy. Unused coins may be lost if you clear your data, delete your account, or if the App is discontinued.
• Price changes. We may change prices, coin costs and what each plan includes. Price changes for existing subscriptions are communicated according to App Store or Google Play rules, and you can cancel before they take effect.

7. Ads and third-party services

The App shows ads to non-subscribers and relies on third-party services (such as AI providers, app stores, analytics and ad networks). Their own terms may apply, and we are not responsible for third-party content, websites or services.

8. Changes and availability

We may update, change or remove features, templates and AI models, and we may update these Terms. We will post the new Terms here with a new effective date and, for significant changes, notify you in the App. Continued use after a change means you accept the updated Terms. We do not guarantee that the App will always be available or error-free.

9. Termination

You can stop using the App at any time and delete your data as described in the Privacy Policy. We may suspend or end your access, and remove content, if you break these Terms or the law, or to protect other users or the App. Sections that by their nature should survive (such as content rules, disclaimers and limits of liability) continue after termination.

10. Disclaimer

To the extent permitted by law, the App and all results are provided “as is” and “as available”, without warranties of any kind, including fitness for a particular purpose, accuracy or likeness of results, and non-infringement.

11. Limitation of liability

To the extent permitted by law, Sunmare Digital is not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, arising from your use of the App or its results. Our total liability for any claim relating to the App is limited to the amount you paid us for the App in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, such as liability for intent or gross negligence, or your rights as a consumer under mandatory law.

12. Indemnity

You agree to compensate us for claims by third parties that result from photos you uploaded without the right to do so or from your breach of these Terms, to the extent permitted by law.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of Turkey. The competent courts and enforcement offices of Turkey have jurisdiction, without prejudice to mandatory consumer protection rules that allow you to bring a claim in the courts or consumer arbitration bodies of the place where you live.
